Terms of Service

Introduction

Welcome to Welkome! These Terms of Service ("Terms") govern your use of the Welkome platform and services (the "Service"). Please read these Terms of Service ("Terms") carefully before using the Welkome platform (the "Service"). The Service is owned and operated by CyberWorks, which is the parent company and owner of the product Welkome. Throughout these Terms, "Welkome," "we," "us," or "our" refers to CyberWorks as the operating entity of the Welkome Service.

1. Acceptance

By creating an account or using Welkome ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of the Service

Welkome is a SaaS platform that allows short-term rental hosts to create, manage, and share AI-generated welcome guides for their guests. The Service includes guide creation, QR code generation, multi-language translation, guest management, and financial tracking (paid plans).

3. Account and eligibility

  • You must be at least 18 years old to use the Service.
  • You are responsible for maintaining the security of your account.
  • You must provide accurate information when registering.
  • One person or entity may not maintain more than one free account.

4. Plans and payment

The Service offers a free Starter plan and paid Essential (€9/month) and Pro (€19/month) plans. Paid plans are billed monthly or annually through Paddle, our payment processor. All prices are in euros and include VAT where applicable.

We reserve the right to change pricing with 30 days' notice. Continued use after the effective date constitutes acceptance of the new pricing.

5. Cancellation, termination, and refund policy

a) Cancellation by you

  • Free Plan: You can stop using the Free Plan at any time with no obligation.
  • Paid Plans:You may cancel your subscription at any time from your dashboard (Settings > Subscription). Cancellation takes effect at the end of the current paid billing period. You retain access to paid features until that date.

b) Termination by us

We may suspend or terminate your account immediately, without prior notice or liability, for any reason, including breach of these Terms.

c) General refund rule

All payments are processed by Paddle (paddle.com), our Merchant of Record. As a general rule, all transactions are non-refundable and non-exchangeable, except as required by applicable law or as described below.

d) Statutory withdrawal rights

Depending on your country of residence, you may have a statutory right to withdraw from a subscription contract within a set period of your first payment:

  • EU / EEA / Switzerland / UK: 14 days from the date of purchase.
  • Turkey / Israel: 14 days from the date of purchase.
  • South Korea / Brazil / Canada / China: 7 days from the date of purchase.
  • Singapore: 5 days from the date of purchase.
  • All other countries: No statutory withdrawal right; the general non-refundable rule applies.

These statutory rights apply to your first payment only and do not apply to automatic subscription renewals — except for UK customers on Annual Plans, who receive a new 14-day window upon each yearly auto-renewal.

e) How to request a refund

To exercise your withdrawal right, contact us at contact@welkome.app before the applicable deadline, or cancel directly through your dashboard (Settings > Subscription > Cancel). Refunds are processed via your original payment method within 14 days of approval. Access to paid features is revoked immediately upon refund issuance.

f) Policy after the withdrawal period

After the applicable withdrawal period has expired, all payments are non-refundable. We do not provide refunds or credits for partial subscription periods, unused time, mid-cycle cancellations, or subscription renewals. If you are on an Annual Plan and cancel after the withdrawal window, access to paid features continues until the end of your paid one-year term.

g) Discretionary refunds

Outside of statutory rights, Paddle may, at its sole discretion, approve a refund within 14 days of purchase taking into account factors such as product type, usage, and stated reasons. Such approval does not constitute an obligation to grant similar refunds in the future.

h) Material technical defects

If the Service suffers a material technical defect that prevents normal use, you may be entitled to a refund under applicable consumer protection law. Please contact us first at contact@welkome.app before escalating to Paddle support.

i) Fraud and abuse

Refund requests showing evidence of fraud, refund abuse, or other manipulative behaviour will be denied.

6. Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any regulations.
  • Upload content that is harmful, fraudulent, or violates third-party rights.
  • Attempt to reverse-engineer, scrape, or abuse the Service or its APIs.
  • Share your account credentials with others.
  • Use the Service to generate spam or misleading content.

Violation of these terms may result in suspension or termination of your account without notice or refund.

7. AI-generated content

Welkome uses OpenAI to generate guide content based on information you provide. You are responsible for reviewing and editing AI-generated content before publishing. We do not guarantee the accuracy of AI-generated content. You retain ownership of the content you create and publish through the Service.

By using the Service, you grant Welkome a limited license to process your property data solely for the purpose of providing the Service.

8. Intellectual property

The Welkome platform, its design, and underlying technology are owned by Welkome. You retain all rights to the content you create. You grant us a non-exclusive, worldwide license to host and display your content as necessary to operate the Service.

9. Limitation of liability

To the maximum extent permitted by law, Welkome shall not be liable for indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to loss of revenue, data, or business opportunities.

Our total liability for any claim related to the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

10. Service availability

We aim for 99.9% uptime but do not guarantee uninterrupted access. We may suspend the Service for maintenance with reasonable notice. We are not liable for downtime caused by circumstances beyond our reasonable control.

11. Account deletion

You may delete your account at any time from your account settings. We may delete accounts that have been inactive for over 24 months on the free plan, with 30 days' prior notice.

12. Governing law

These terms are governed by French law. Any disputes shall be subject to the exclusive jurisdiction of the courts of Paris, France.
